Terms & Conditions Of Business

These terms and condition shall represent a legally binding contract between the client or employer (the “Client”) and NannyFinders Directory Agency Canada Ltd (the “Agency”). The verbal/written instruction by the client or NannyFinders Directory Agency Canada Ltd to submit suitable candidates for contact or interview or arrangement of interviews shall constitute acceptance by the client of these terms and conditions. The term “Candidate” means a person introduced by NannyFinders Directory Agency Canada Ltd. NannyFinders Directory Agency Canada Ltd is acting as an employment agency only.

The employer is responsible and accountable for Tax deductions to be made from the employee’s salary where applicable. Employer is responsible and in accord pay and conditions with the Candidate prior to making the commitment. Conditions relating to Pay, Tax, MSP, Working Hours, Accommodation (if live-in), Notice and Grievances, shall be notified in writing to the Candidate upon engagement.

FEES

Client agrees to notify NannyFinders Directory Agency Canada Ltd immediately an engagement is accepted and to pay agency fee prior to the commencement of position. All relevant fees accompany these terms and conditions. Fees are payable by the client on the acceptance, either verbally or in writing by a candidate of a position with the client. It is the responsibility of the client/employer to notify the agency if a candidate has been offered employment. Fees at the current rate of NannyFinders Directory Agency Canada Ltd charges, are payable within 5 days from the date of the invoice submitted by NannyFinders Directory Agency Canada Ltd.  NannyFinders Directory Agency Canada Ltd reserves the right to charge the client/employer a 28% surcharge on all account not settled within this period and in addition to re-claim any costs (including debt collector’s fees) incurred as a result of chasing from payment.

CONFIDENTIAL INFORMATION

All candidate details are confidential and shall be treated as such by the client and not passed to any third party. All communication, whether written or oral and however communicated shall be confidential between the parties. Should information be passed or recommend to a third party that results in employment for the candidate whether temporary or permanent, then the client will be liable for the relevant full fee as in the order has been made by the client itself and these terms and conditions shall apply accordingly.

INTRODUCTION BY THIRD PARTIES

It is the obligation of the client to immediately inform NannyFinders Directory Agency Canada Ltd when a candidate is introduced by NannyFinders Directory Agency Canada Ltd who has already been introduced by a third party. If the client does not so inform NannyFinders Directory Agency Canada Ltd then it will be presumed that the introduction has been effected by NannyFinders Directory Agency Canada Ltd and the relevant fee will become payable.

NannyFinders Directory Agency Canada Ltd takes all reasonable care to interview candidate and to take up references and to investigate qualifications attitude and experience. The Client however undertakes to NannyFinders Directory Agency Canada Ltd to use their best endeavors to establish that the candidate is in fact a suitable person to undertake the appointment in question and that the terms and conditions offered in the contract of employment with the Client are suitable to the applicant. The Client further undertakes to notify NannyFinders Directory Agency Canada Ltd in respect of any wants or dissatisfaction with the applicant.

No refunds shall be payable on temporary or permanent placements, however the NannyFinders Directory Agency Canada Ltd will use its best endeavours to find a replacement at no further fee.

Late payment of NannyFinders Directory Agency Canada Ltd fees shall attract an interest rate of 28% per calendar month.

LIABILITY

NannyFinders Directory Agency Canada Ltd endeavors to provide client with only the most suitable candidates. However the final decision to employ a candidate is the sole responsibility of the client and NannyFinders Directory Agency Canada does not accept any liability for any kind of inconvenience, loss or damage howsoever arising and whether caused directly or indirectly from an act or omission of a candidate introduced by NannyFinders Directory Agency Canada Ltd.

Similarly no warranty is offered in respect of the suitability, honesty, capability or character of any candidate introduced by NannyFinders Directory Agency Canada Ltd and employed by the client. Candidates are not the employees of NannyFinders Directory Agency Canada. The client is responsible for ensuring that their home contents insurance is includes cover for employers and public liability insurance for domestic workers, including childcares. NannyFinders Directory Agency Canada does not exclude or restrict liability for death or personal injury resulting from its negligence.

Notwithstanding the best endeavors of NannyFinders Directory Agency Canada Ltd with regard to the above clause NannyFinders Directory Agency Canada Ltd accepts no liability for loss damage and expense caused to the client or others through acts of omission by the candidate or acts in breach of the candidate contract of employment with the client or NannyFinders Directory Agency Canada Ltd. It is incumbent on the client to ensure that the candidate is in possession of all the information both ordinary and specialist to enable the candidate to undertake the duties required.

NannyFinders Directory Agency Canada Ltd are not employers and conducts their business as agents only for the purpose of effecting introductions between persons desiring to enter into contracts for services.

NannyFinders Directory Agency Canada Ltd give no representation or warranty that any situation remains or will remain available or that any client is or will be available to fill any situation.          
          
  

NannyFinders Directory Agency Canada Ltd reserves the right to change or add to the above terms and conditions without prior notification.

No variation from these terms and conditions will be made unless in writing from a director of NannyFinders Directory Agency Canada Ltd. This agreement is governed and construed in accordance with the laws of Canada, whose jurisdiction shall bind each party.
